Terms of Service

These Terms of Service apply when you use Negotiation Tool ("the Service", "we", "us"), run by pobodoq. By creating an account or using the Service, you agree to them. If you do not agree, do not use the Service. For the operator's details, see our Imprint.

1. The Service

Negotiation Tool helps you prepare and track negotiations. You can:

• start a negotiation from a template, set its topics and targets, and answer questions about your position
• get a strategy and tactics drafted from your answers by fixed rules, and change them in your own words
• read a one-page Meeting brief before a meeting and log a round after it
• keep what you learn about the other side under Counterparties
• add team members to a negotiation
• use AI, if you turn it on with an AI service of your choice

2. Not advice

The power balance, the recommended approach, the strategy, the tactics and any text written by AI are suggestions drawn from what you entered. They are not legal, financial, tax or other professional advice, and they do not promise any outcome. You decide what to do in your negotiation, and you are responsible for it. For an important decision, ask a qualified adviser.

3. Eligibility

You must:

• be at least 16 years old
• have the legal capacity to enter into agreements
• give accurate information

If you use the Service for an organisation, you confirm that you may accept these terms for it.

4. Your account

You sign up with your email address and a password, and confirm the address from the email we send you, or with your Google account. Keep your password safe, and add two-factor authentication or a passkey if you can. You are responsible for what happens under your account. If you think someone else has used it, tell us at once at hello@dramagoapp.com.

5. Your content

What you enter stays yours. You give us a non-exclusive, worldwide licence to store, process and show it, only as far as we need to run the Service for you and for the team members you add, and to send it to the AI service you chose when you use AI. The licence ends when you delete the content or your account.

You confirm that you may enter what you enter. That includes what you note about other people, such as the people on the other side: keep it to what your negotiation needs, and follow the data protection law that applies to you. Do not enter anything you are bound to keep secret unless you may store it with a service like ours.

6. Team members

When you add someone to a negotiation, they can see and change everything in it, including its rounds, and they can add and remove other team members. Only its owner can delete the negotiation. Add only people you trust with it.

7. AI

AI is optional and off until you turn it on. You choose the AI service and give its address, its model and, if it needs one, its API key. Your use of that service is governed by its own terms, and any cost it charges is yours.

Text written by AI can be wrong or incomplete. Read it before you rely on it. Nothing AI writes is saved until you save it.

8. Acceptable use

You must not:

• use the Service to break the law or anyone's rights
• try to reach other users' accounts or data
• disrupt, overload or attack the Service, or test its security without our permission
• copy or scrape the Service by automated means, or resell it
• use it to store or send malware, spam or unlawful material

9. Prices and payments

Some features or plans of the Service may be paid. Before you pay, you are shown the price, what it includes, how long it runs and whether it renews. Payments are processed by the payment provider named at checkout, and we do not store your card details. Refunds are covered by our Refund Policy.

10. Availability and changes

We work to keep the Service running, but it may be interrupted, changed or discontinued, and we may add, change or remove features. If we discontinue the Service, we tell you in advance where we can, so you have time to save what you need.

11. Ending your use

You can stop at any time and delete your account in Settings → Profile. We may suspend or close an account that breaks these terms, harms other users or puts the Service at risk. Where we can, we tell you first and give you a chance to put it right.

12. Intellectual property

The Service, its software, design, templates and texts belong to pobodoq. You may use them only to use the Service. Your content stays yours, as section 5 says.

13. Limitation of liability

We provide the Service as it is and as available. To the maximum extent permitted by law, we are not liable for:

• loss of data or of availability
• the decisions you make and the outcome of your negotiations
• the AI service you chose and other third parties
• indirect or consequential loss

Our total liability is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits a liability that the law does not allow to be limited.

14. Indemnification

You agree to indemnify and hold harmless pobodoq from claims that arise from the content you enter, your misuse of the Service, or your breach of the law or of anyone's rights.

15. Changes to these terms

We may update these terms. The new version is published on this page with its date. If a change matters, we tell you by email or in the Service before it takes effect. If you keep using the Service after that, the new terms apply. If you do not agree with them, you can delete your account.

16. Disputes

If something goes wrong, write to us first, and we will make reasonable efforts to settle it with you. These terms do not take away any protection that the consumer law of the country where you live gives you.
